The design can be made by hand, or by any tool or machine, or by combination also. The design is judged merely by eye, without the help of any other mechanical device.
Design does not include any mode or principle of construction or anything which is mere a mechanical device. It also does not include any trademark or any artistic work. If you register a design, you will be protecting the external appearance of the article. Registered Designs are used primarily to protect designs for industrial use.
An applicant may apply for the registration and submit the application at the Design Office at Kolkata or at other branch offices. The application should be filed in the prescribed form along with the prescribed fees, stating name & full address, nationality, name of the article, class number, and address for service in India. The application is required to be signed either by the applicant or by his authorized agent.
The design applications are taken up for examination and objections, if any, are raised thereto. The applicant is required to correct the objections if any raised and resubmit the application to the office for acceptance within the stipulated time.
The design office issues the certificate granting copyright in registered design after the objections, if any, are removed to the satisfaction of the department. The registration certificate is valid for 10 years from the date of registration and the term can further be extended for another 5 years by filing the application for extension.
